"LIVE's DATE NIGHT MAKEOVER"

SEGMENT SEARCH 2012 GUIDELINES



  1. GENERAL DESCRIPTION: No purchase necessary. As many as ten participants will receive a makeover and a date with their significant other. They will appear on LIVE WITH KELLY ("LIVE") for the makeover. LIVE reserves the right to vary the number of participants selected. Makeovers subject to conditions set forth below.


  2. SELECTION OF PARTICIPANTS: Up to 25 potential participants will be selected on the basis of their photos (non-returnable), a letter no longer than one page (8½" x 11") reflecting personality, creativity and potential for change. Participants will be selected from among the potential participants based on the above criteria and a possible phone call and makeover potential. LIVE staff, in their sole discretion, will select the participants. Decisions of the LIVE judges on all makeover related matters are final and non-appealable. By submitting materials, participants agree to be bound by the decisions of the judges and the guidelines. In the event of disqualification for any reason, LIVE may, at its sole discretion, present the makeover opportunity to another participant.


  3. ELIGIBILITY: All participants, with proof presented, must be 18 years of age or older, a legal resident of the United States or Canada, with the exception of Guam, the Province of Quebec, Canada and where prohibited by law. Selected participants must be available to appear on LIVE in New York between July 9th, 2012 and July 27, 2012. Choice of exact date for selectee’s appearance is at LIVE's sole discretion. If selectee is unable to appear on a designated date, selectee will be disqualified. Employees of American Broadcasting Companies, Inc., Buena Vista, LIVE, and their parent, affiliate, subsidiary and successor companies, and immediate family members/members of the same household of anyone so employed, are not eligible. Any submittor not abiding by the Guidelines will be disqualified.


  4. HOW TO SUBMIT MATERIALS: All submissions must be received by 5:00 pm Eastern Time on Tuesday, June 26, 2012
    Individuals who want this makeover must send LIVE a short letter (one page or less) telling us about their relationship, how long they've been together, why he/she needs the makeover and a recent photo (non-returnable). All entries become the property of LIVE and may be used in any manner and any media. At LIVE's sole option, submissions (including note and/or photo) may be posted on the show's website.

    Letter must be original work of Submittor and may not be previously published, and no third party may have any rights or claims to such materials. All submissions (including, without limitation, photo and letter) become the property of the Makeover sponsors and may be used in any manner and in any media worldwide, in perpetuity. At LIVE's sole discretion, submissions (including note, and photos) may be posted on LIVE's web site. All submissions become the sole property of LIVE and will not be returned or acknowledged, whole or in part.

    Use our on-line submission form to submit your letter, contact information and properly formatted photo as an attachment. Follow the posted instructions on the appropriate file formats and sizes for submitting your photo.

    Materials may not be submitted except for as set forth above. Any materials submitted in any other format or to any other address will not be considered for potential participation in this segment.

    LIVE WITH KELLY can provide no further technical support and accepts no responsibility for insuring the receipt of your submission and photo. If you experience difficulties trying to submit your materials on-line, we recommend you send your letter and photo via U.S. mail to us at the above address to be received by the submission deadline.


  5. POTENTIAL ADDITIONAL SUBMISSION MATERIALS: Up to 25 of the potential participants may be required to submit a video (2 minutes or less, in a format designated by the show) offering further explanation of their written entry and reflecting personality, creativity and need for makeover. All such requests will be made at the sole discretion of LIVE staff.


  6. MAKEOVER: Selected participants may be given a makeover, which includes hair, make-up (for women), clothing, and possible dental and dermatologic work. The selected participants would be permitted to keep any clothing. Selected participants may be asked to appear on LIVE between July 9th, 2012 and July 27, 2012 (exact dates to be determined by LIVE). If necessary, at our sole option, certain transportation and accommodations costs will be provided for participants located outside of the New York Metropolitan Area. Meals up to $50 per person/per day will be reimbursable if selected participant is from out of town. Approximate value of the makeover is $1,000 per person. LIVE reserves the right to cancel or postpone the segment featuring the Makeover. LIVE is not responsible for program preemptions/rescheduling and in no way guarantees the use of any recorded or live appearance by any selected participant.

    All taxes associated with items received for participation in this segment are the sole responsibility of the recipient. An IRS Form 1099 will be issued for a participant who receives items, in total, with a value of $600 or greater. Each participant must sign an Affidavit of Eligibility, Indemnification and Release: (a) allowing LIVE, or any party it so designates, to use selected participant’s name, voice, image and/or submission materials for programming, promotional and publicity purposes; and (b) releasing and holding harmless American Broadcasting Companies, Inc., and Buena Vista Television and their respective parent, subsidiary and affiliated companies and their respective officers, directors, employees, heirs, assigns and agents, and any other participant in this promotion, (collectively, "Released Parties") from and against any liability, expense or claim arising from or relating to participation and/or appearance in this potential segment including, without limitation, travel to or from LIVE and/or acceptance or use of the makeover or any other item received as part of the potential segment. By submitting materials for consideration all participants agree to release, discharge and hold harmless Released Parties from and against any liability, expense or claim arising from or relating to participation in this search. Submittors selected for further participation agree to execute any and all additional releases or authorizations requested by LIVE. Failure to comply with any of the above will result in disqualification and forfeiture of any consideration received.


  7. RESTRICTIONS: Sponsors are not responsible for mail that is lost, stolen, late, illegible, incomplete, damaged, mutilated, misdirected, altered, tampered with or postage-due.

    If for any reason the Makeover Segment is not capable of running on-line as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the sponsor that corrupts or affects the administration, security, fairness, integrity or proper conduct of this Makeover Segment, the sponsor reserve the right, at their sole discretion, to cancel, terminate, modify or suspend the internet portion of the Makeover Segment and/or to disqualify any individual who tampers with the submission process. CAUTION: ANY ATTEMPT BY A VIEWER TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE MAKEOVER SEGMENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

    The Sponsor of the Makeover Segment does not assume any responsibility for incorrect or inaccurate capture of submission information, including but not limited to technical malfunctions, human or technical error, seeding or printing errors, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect, or failures of any telephone or computer line or network, computer equipment, software, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating or downloading any materials in the makeover segment. Submitted materials/data that have been tampered with or altered are void. In the event this Makeover Segment is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sponsor reserves the right to cancel, terminate, or suspend the online play of the Makeover Segment and, in such event, to select participants for any remaining makeovers from among all valid submissions received, up to such time of cancellation, termination, or suspension.
